asked the Secretary of State for the Environment if he will now make operative Section 41 of the Control of Pollution Act 1974.

I would refer to the reply given to my hon. Friend the Member for Kingswood (Mr. Terry Walker) on 3rd February—[Vol. 885, c. 409–414.]—which stated that the main provisions of Part II of the Act would be brought into force in two stages between the late autumn of this year and the middle of 1976. We shall be consulting the water authorities and other interested bodies on the precise timing for the implementation of the various provisions, including Section 41.
