Employee's Rights On Insolvency Of Employer

I beg to move Amendment No. 133, in page 44, line 23, leave out from first 'the' to second 'the' in line 26 and insert:

'the relevant date'.
The purpose of this amendment is to ensure that a debt in respect of maternity pay which occurs both after the date of termination of employment and the date of insolvency becomes a payment by the redundancy fund under the clause. It arises out of discussions in Committee, and I hope that it is acceptable to the House.

Amendment made: No. 134, in page 44, line 32, at end insert—

'(1A) In this section the "relevant date" in relation to a debt means—
  • (a) as respects maternity pay, the date of the employee's application to the Secretary of State under this section; and
  • (b) as respects any other debt, the date on which the employer became insolvent or the date of the termination of the employee's employment, whichever is the later. '.—[Mr. John Fraser.]
