asked the Secretary of State for the Home Department (1) when he expects to receive the report of the Chief Constable of Merseyside concerning his investigations into the events surrounding the death of Mr. Jimmy Kelly in Merseyside.(2) whether he will order an immediate inquiry into the circumstances surrounding the death of Jimmy Kelly on Merseyside.

In accordance with the provisions of section 49 of the Police Act 1964, allegations against the Merseyside Police concerning the death of Mr. James Kelly are currently under investigation by a senior officer from another force. I understand that the Chief Constable of Merseyside expects to receive his report by the end of the week, and will then submit it to the Director of Public Prosecutions for his independent consideration of the possible need for criminal proceedings.
