To ask the Secretary of State for Social Security, if he will take steps to provide Mr. Charles Haggarty of Marloch avenue, Port Glasgow, with an ex-gratia payment pending the revision of guidance to adjudication officers following the judgment of the Court of Appeal in the case of McKiernon v. Secretary of State for Social Services.

No. We are still considering the full implications of the judgment in the case of McKiernon. The chief adjudication officer has still to issue guidance on cases which have been disallowed under regulation 25 of the Social Security (Industrial Injuries) (Prescribed Diseases) Regulations since the date of that judgment.
