To ask the Attorney-General what guidelines he issued in (a) October and (b) November 1995 in respect of issuing public interest immunity certificates in the Ordtech appeal hearing; and what factors underlay his advice. [9496]

Any advice given to Government concerning public interest immunity following the decision of the House of Lords in ex parte Wiley in July 1994 will have taken account of the change of approach signalled in that case. However, by convention, the fact as to whether the Law Officers have advised on a given matter is not disclosed, nor is the content of any advice which may have been given.
