To ask the Secretary of State for Health whether she has issued guidance to NHS trusts about their potential liability relating to decisions not to provide continuous positive airways pressure equipment to those patients diagnosed with obstructive sleep apnoea; and if she will make a statement. No. It is for the NHS locally to commission services for the people they serve, informed by clinical judgment of the actual needs and any advice they have from the National Institute for Health and Clinical Excellence (NICE). NICE has not yet completed its consideration of continuous positive airway pressure for people with sleep apnoea.
