Volume 454: debated on Wednesday 13 December 2006

To ask the Secretary of State for Education and Skills with whom responsibility lies for (a) setting the conditions for BBC Jam and (b) monitoring compliance with those conditions; and if he will make a statement. (108854)

I have been asked to reply.

My right hon. Friend the Secretary of State set the conditions for the approval of BBC Jam. The conditions were part of a letter approving the service (at that time known as the Digital Curriculum) from my right hon. Friend to the then Chairman of the BBC, dated 8 January 2003.

Primary responsibility for ensuring compliance with these conditions currently lies with the Board of Governors. Under the terms of the new Charter, the effect of conditions attached to approvals granted by the Secretary of State must be incorporated into the service licence that the BBC Trust should issue to cover the service. Primary responsibility for ensuring compliance with the licence will rest in future with the BBC Trust.
