To ask the Secretary of State for Justice how many legally-aided clinical negligence cases were closed in 2007; and how many of these cases resulted in an award of damages or a settlement involving an agreement to pay damages or compensation. (187920)

Figures covering the whole of 2007 will not be available until after the end of the current financial year. However, 5,584 legally aided clinical negligence cases were closed in 2006-07. In 160 of these cases, the solicitors reported that the outcome was unknown, as the client had ceased to give instructions or was proceeding under other funding or as a litigant in person. Of the remaining cases, 300 resulted in an award of damages, and 1,708 in a settlement involving an agreement to pay damages or compensation.
