Departmental Fixed Penalties

To ask the Secretary of State for Justice what administrative financial penalties may be levied by his Department and its agencies. (253587)

Administrative financial penalties arise where a department has the authority to charge a financial penalty without the need to resort to court proceedings. They exclude interest charged on late payment of invoices.

The Legal Services Complaints Commissioner has the power under section 52 of the Access to Justice Act 1999 to levy a financial penalty on the Law Society.

All other penalties levied by the department or its agencies are through the courts.
