To ask the Secretary of State for Defence what recent discussions he has had with the US authorities on the (a) legal status, (b) detention conditions and (c) prospects of trial or release of the two individuals detained by British forces in Iraq in 2004 and subsequently rendered to the Bagram Theatre Internment Facility in Afghanistan. The MOD maintains an ongoing dialogue with US authorities on a range of detention-related matters, including the two individuals the right hon. Gentleman referred to. The most recent contact of this nature occurred in mid-December 2009.

To ask the Secretary of State for Defence for what reasons his Department has withheld the names of two individuals detained by British forces in Iraq in 2004 and subsequently rendered to the Bagram Theatre Internment Facility in Afghanistan. (307814)

It is not for me to release personal data to third parties, therefore, I am withholding this information. The International Committee of the Red Cross has had regular access to these two individuals.
