Extradition: Human Rights

asked Her Majesty's Government:

Whether, by virtue of Section 6 of the Human Rights Act 1998, the powers conferred upon the Secretary of State by the Extradition Act 2003 must be exercised in a way that is compatible with the convention rights.[HL7028]

The Secretary of State, as a public authority, is bound by provisions of Section 6 of the Human Rights Act 1998 and is forbidden from acting in a way that is incompatible with convention rights.
