asked Her Majesty's Government:

How many local authorities are not fulfilling their statutory obligations under Section 8 of the Small Holdings and Allotments Act 1908. [HL4218]

Under the Allotments Act 1925, a local authority must obtain consent from the Secretary of State before selling, appropriating, disposing of or using for any other purpose land which is designated for use, or is being used, as an allotment. The duty to obtain consent before disposal falls upon local authorities to fulfil. We have no evidence to suggest that local authorities are not fulfilling their duty.
