Whether the European Convention on Human Rights applies to extradition cases involving United Kingdom citizens. [HL4595]
Under the Extradition Act 2003 the district judge in this country must consider whether a person's extradition would be compatible with that person's ECHR rights, within the meaning of the Human Rights Act 1998.
These rights are applicable to everyone who finds themselves the subject of an extradition request made to the UK, irrespective of their nationality.
