asked Her Majesty's Government:

Further to the Written Answer by Lord McKenzie of Luton on 21 November (WA 84–5), whether it is appropriate that health and safety legislation should be invoked in circumstances where the police and security forces are dealing with terrorist incidents, particularly in light of the specific exemptions from criminal prosecution in these circumstances for the police and the armed forces set out in the Corporate Manslaughter and Corporate Homicide Act 2007. [HL609]

Health and safety legislation is potentially applicable in the circumstances described. Whether it is invoked is a matter for the prosecuting authorities applying the guidelines set out in the Code for Crown Prosecutors.
