asked Her Majesty's Government:

Whether the Rural Payments Agency has been instructed not to penalise applicants who fill in the SP5 form as it was originally distributed before the European Commission changed the 10-month rule. [HL3350]

Guidance on how to complete the relevant parts of the form is set out in the How to Complete Your SP5 Application Form booklet issued to applicants. This is designed to ensure that the issue of penalties does not arise.
