Community Service Orders
asked Her Majesty's Government:Whether they will give the total hours of community service handed down by the courts in each of the last five years, showing the figures for England, Scotland and Wales separately. [HL3839]
The available information from the Home Office and the Scottish Executive Justice Department Court Proceedings Databases shows the total hours of community service orders imposed by all courts in England, Scotland and Wales for each year from 1996 to 2000.Information for 2001 will be available in the autumn.

Wandsworth Prison: Healthcare Centre
asked Her Majesty's Government:When the planned hospital/healthcare centre at Wandsworth prison will be built to replace the present facility. [HL3874]
The new healthcare centre at Wandsworth prison is scheduled for completion in January 2003.
Biofuels: Excise Duty
asked Her Majesty's Government:Further to the Written Answer by Lord McIntosh of Haringey on 22 April (
WA 2), what rate of duty should be paid on a biofuel when it is being used exclusively in an off-road or "red diesel" context. [HL3976]
Under Directive 92/81/EEC Member States must tax biodiesel used in stationary motors; plant and machinery used in construction, civil and engineering and public works; and vehicles intended for use off the public roadway or which have not been granted authorisation for use mainly on the public highway as a road fuel, as a substitute for gas oil (red diesel).They are allowed to tax it at a reduced rate above the minimum rate set out in Directive 92/82/EEC (currently €18 per 1,000 litres). The Government have included legislation in the Finance Bill 2002 to provide that biodiesel used as a substitute for red diesel bears duty at the same rate, with effect from Royal Assent.
Channel Islands And Isle Of Man: Taxation
asked Her Majesty's Government:Whether the Channel Islands and the Isle of Man are free to arrange their own tax regimes. [HL3996]
Legislation on taxation in the Crown dependencies has always taken the form of laws enacted by the legislatures of the Crown dependencies. All primary legislation passed by those legislatures requires the assent of the Queen in Council.
asked Her Majesty's Government:How they react to the letter of 12 April from the President of the Jersey Policy and Resources Committee, Senator Horsfall, to the Paymaster General on the European Union Code of Conduct on Business Taxation. [HL3997]
The report of the Code of Conduct Group on Business Taxation to the ECOFIN Council on 29 November 1999 lists 66 tax measures in European Union member states and their dependent or associated territories which are considered to have harmful features. Four of these are in Jersey. The United Kingdom wishes to see the harmful aspects of all 66 measures removed.
Business Taxation: Eu Code Of Conduct
asked Her Majesty's Government:What is the state of play on the European Union Code of Conduct on Business Taxation and Directive 2001/400. [HL3998]
Work on the EU code of conduct for business taxation and on taxation of savings is being taken forward in accordance with the timetable on the tax package adopted by the ECOFIN Council on 10 July 2001, with a view to reaching agreement on the tax package as a whole no later than by the end of 2002.
asked Her Majesty's Government:Whether under the European Union Code of Conduct on Business Taxation or Directive 2001/400 they propose to treat Jersey differently from Guernsey, the Isle of Man or any of the overseas territories; and, if so, why. [HL3999]
The Government wish to see all UK Crown dependencies and overseas territories meet international standards of fair tax competition.
India And Pakistan: Export Of Nuclear-Related Goods
asked Her Majesty's Government:What is their policy regarding exports of nuclear and nuclear-related materials and services to users in India and Pakistan and on contacts with India and Pakistan relating to their nuclear programmes. [HL3338]
As the then FCO Minister of State, my right honourable friend Mr Tony Lloyd MP, made clear on 10 July 1998 (Official Report, col. 687), many countries, including the UK, have in place strict controls on the export of nuclear-related goods to India and Pakistan. The UK also exercises caution over contacts between personnel from the British nuclear industry and their Indian and Pakistani counterparts. Current tensions between India and Pakistan demonstrate the need for both countries to exercise restraint.The events of 11 September highlighted the fact that some terrorist groups will use any means to achieve their ends. We know that Osama bin Laden and the Al-Qaeda network have shown an interest in developing chemical, biological and nuclear weapons. To ensure that such ambitions are not realised, we are encouraging all countries, including India and Pakistan, to take all steps necessary to ensure the better physical protection of their nuclear assets. We will be encouraging both countries to consider measures which contribute to the safety and security of their nuclear programmes.Bearing these factors in mind, and consistent with our obligations under the non-proliferation treaty, we have revised our policy as follows:We will continue to deny all export licence applications (ELAs) for items listed on the Nuclear Suppliers Group (NSG) Dual-Use List to nuclear and nuclear-related end users in India and Pakistan. We will consider all applications for other items assessed as licensable, including those licensable under the WMD end use control, with particular vigilance in making licensing decisions on a case by case basis. Licences may be issued if there are no end use concerns. Consistent with our obligations under the non-proliferation treaty, licences may also be issued in exceptional cases where the Government are satisfied that the proposed exports will contribute to the physical protection or security of civil or military nuclear facilities or assets in India.We will continue to discourage contacts by UK nuclear scientists or those working in the UK nuclear industry with their counterparts from, or personnel who we know are likely to work in, nuclear or nuclear related organisations in India or Pakistan. We will also discourage visits by such counterparts and personnel to UK nuclear facilities. However, this will not apply where such contacts would contribute to the safety and security of India and Pakistan's nuclear programmes, or further the UK's non-proliferation objectives, consistent with our obligations under the nonproliferation treaty.Since earring out their nuclear tests in 1998, neither India or Pakistan has demonstrated sufficient commitment to meet their obligations to reduce nuclear tensions set down in UNSCR 1172. We are now encouraging both countries to engage a bilateral dialogue on nuclear confidence-building measures.
Biological And Toxin Weapons
asked Her Majesty's Government:When they will publish the Green Paper on strengthening the Biological and Toxin Weapons Convention and countering the threat from biological weapons. [HL3993]
Yesterday the Foreign and Commonwealth Office published the Green Paper. Copies have been placed in the Library and it can also be accessed on the FCO website at www.fco.gov.uk.The Green Paper sets out the work that has been undertaken over many years to develop measures to make the 1972 Biological and Toxin Weapons Convention more effective. Committee, and Parliament in general, have supported these efforts, for which the Government are grateful.
The paper expresses our disappointment at the failure of the states parties to agree on the text of a protocol to the convention last year, despite all our efforts. It also explains why, despite this disappointment, it is still essential that efforts continue to find ways in which the convention can be strengthened and to counter the threat from biological weapons.
The Green Paper identifies possible measures that states parties might now consider to strengthen the convention. It discusses UK priorities and the next steps ahead of the reconvened BTWC Fifth Review Conference in Geneva on 11 November. It also invites comments on these proposals and seeks views from honourable Members, NGOs and other organisations and individuals with an interest in this subject.
Lord Chancellor's Department: Assets Of Cultural Significance
asked Her Majesty's Government:Further to the Written Answer by Mr Wills on 9 November 2001 (HC Deb, 487W) whether they will give full details of the 484 antiques and 78 paintings held by the Lord Chancellor's Department. [HL3858]
The two tables below provide details of the 484 operational (e.g. desks, tables, chairs) and 78 non-operational (e.g. paintings, sculptures) antiques and works of art situated throughout the country in buildings within the Lord Chancellor's Department estate as reported to Parliament on 9 November. The reported value for operational antiques of £1,405,062.65 has since been adjusted to £954,851.04. This is mainly due to the reclassification of several high value items as fixtures and technical bookkeeping adjustments.

Gulf War: Vaccines
asked Her Majesty's Government:Whether they will list all the vaccines that were given to members of Her Majesty's Armed Forces immediately prior to and during Operation Granby. [HL3896]
The immunisation programme for Armed Forces personnel in the Gulf conflict involved a number of vaccines. These can he divided into three categories: those which were part of the anti-biological warfare (BW) immunisation programme; routine service health immunisations; and travel and specific immunisations against the risks associated with individuals' particular employment. These are listed below.
Anti-biological warfare immunisations

Routine Service health immunizations
- Poliomyelitis
- Typhoid and Tetanus (TABT)
- Yellow fever
Travel and Occupational immunisations
- Cholera
- Hepatitis A

The majority of personnel deployed during Operation Granby whose routine immunisations would have been in date would not have required occupational immunisation.
Details of the anti-BW immunisation programme, including datasheets on the vaccines used, were published in the Ministry of Defence paper
Background to the Use of Medical Countermeasures to Protect British Forces during the Gulf War (Operation Granby) in October 1997. A further paper entitled Implementation of the Immunisation Programme against Biological Warfare Agents for UK Forces during the Gulf Conflict 1990/1991, dated January 2000, provides details on how the anti-BW immunisation programme was implemented, including estimates of the numbers immunised and on the other immunisations given. Copies of both papers are available in the Library of the House and on the Ministry of Defence's website at www.mod.uk/ gulfwar/issues.
Afghanistan: Depleted Uranium
asked Her Majesty's Government:What equipment, if any, British troops in Afghanistan have to detect the presence of depleted uranium in their area of operations. [HL3932]
British forces have access to a range of radiation and contamination monitoring equipment and specific items are issued to deployed forces when a risk assessment indicates a need for their use. Monitoring equipment was issued for use in Afghanistan by a specialist team from the Joint Nuclear Biological and Chemical Regiment and was subsequently used to confirm the presence of radiation sources in hospital and university buildings in Kabul.
asked Her Majesty's Government:What information British troops in Afghanistan have concerning the use of bombs containing depleted uranium by the United States air force in Afghanistan. [HL3933]
I understand that the United States has not used any munitions containing depleted uranium in Afghanistan.
asked Her Majesty's Government:What information is available concerning the amount of depleted uranium in the so-called bunker-busting bombs. [HL3934]
There are no air-launched bombs containing depleted uranium (DU) in UK service. No bunker-busting bombs containing DU have been used by the US in recent conflicts.
asked Her Majesty's Government:What instructions have been given to British troops in Afghanistan concerning the wearing of NBC (nuclear, biological, chemical) masks while engaged in sweep operations inside caves which have been subject to attack by the United States air force. [HL3935]
The US has not used any munition warranting the use of NBC masks by ground troops in Afghanistan. No specific NBC-related instructions have been issued for sweep operations. Standard medical instructions regarding NBC exposure have been issued, as would be the case in any operation.
Gulf And Balkans Veterans: Depleted Uranium
asked Her Majesty's Government:What progress has been made in developing a test for depleted uranium for Gulf and Balkans veterans. [HL4088]
Contracts have been placed with five laboratories to carry out a pilot study to determine a test that will identify the presence of depleted uranium in urine. The pilot exercise will examine a number of different methods and establish whether a suitably accurate, precise and sensitive test is available. Following assessment of the results of the pilot exercise, arrangements for the main voluntary testing programme will be put in place. If a suitable test is identified, the voluntary test is likely to be availalble in October 2002.It is extremely important that the method of testing be credible to all parties. This pilot exercise is a vital step in ensuring that the correct test is chosen so that both veterans and the Ministry of Defence can have confidence in the results of the voluntary testing programme.
Cps: Damilola Taylor Case
asked Her Majesty's Government:What steps they are taking to learn the lessons from the Crown Prosecution Service handling of the Damilola Taylor case. [HL4049]
I would like to express my deep sympathy for the Taylor family, who still have many questions left unanswered despite an intensive police investigation and a lengthy trial.This was always going to be a difficult case. It is the job of the CPS to bring cases before the courts where in their judgment there is a realistic prospect of a conviction and it is in the public interest to prosecute. It is then the job of the court, in this case the judge and jury, to examine the evidence and decide on guilt or innocence. The approach of the CPS results in cases being brought before the courts that ought properly to be examined in a trial. Inevitably, there will sometimes be acquittals. If the CPS prosecuted only in cases where conviction was near certain, there would be far fewer cases and many guilty people would go free. Where there is an acquittal after a contested trial it should not be assumed that there has been a failure in the criminal justice system or that it was in any way wrong for the CPS to bring the case.
However, it is important now that we take time to learn any lessons. I therefore asked the Director of Public Prosecutions last Friday to look into the handling by the prosecution of the case, to consider whether there are implications for the conduct of future cases and to make recommendations. He will involve HM CPS Inspectorate in the review. I have particularly asked the director to examine whether the time has come to introduce a system where, before trial, interviews of certain key witnesses are conducted by the prosecutor in a limited category of cases.
The review will report by mid-summer.
Railways
asked Her Majesty's Government:When the report which they commissioned from consultants Mercer into the future structure of the railways will be complete; and whether a copy will be placed in the Library of the House. [HL3965]
Mercer Management Consulting has been commissioned to carry out a wide-ranging consultation of rail industry stakeholders to gather views about all aspects of the UK railways. This is at an advanced stage but the date of and the arrangements for its completion have not yet been set.
Planning Green Paper
asked Her Majesty's Government:Further to the statement by Lord Falconer of Thoroton on 17 April (HL Deb, cols. 1020–26) and the answer by Lord Falconer of Thoroton on the Green Paper on planning on 24 April, whether those concerned with the future of the planning system would be able to comment on a White Paper, possibly incorporating a draft Bill, more fully and helpfully than on a ministerial Statement; and whether a White Paper and the opportunities it presents for participation in the development of policy would meet best practice in consultation more closely than a statement. [HL4009]
As I made clear in the exchanges to which the noble Baroness refers, the Government are committed to a continuing dialogue on the implementation of the planning Green Paper. The policy statement, which the Government plan to issue before the Summer Recess, will set out the Government's thinking in response to the consultation on the Green Paper. Our Green Paper was issued to allow a full consultation before the Government made any policy statement, whether in the form of a Statement or White Paper.
Gcse Syllabuses
asked Her Majesty's Government:Whether the syllabuses for all new GCSEs which are to be introduced in September 2002 are with the schools now; and whether the schools have the necessary training, equipment and materials available for teaching the newly introduced subjects. [HL3827]
The Qualifications and Curriculum Authority has accredited 27 out of the 28 awarding bodies' specifications and associated specimen papers. The final one will be accredited soon. These are available now via the awarding bodies' websites.On training and support, the department has funded an extensive programme for schools and colleges to support the expansion of vocational opportunities at key stage 4, including the introduction of the new GCSEs. In addition, the awarding bodies have run training and support events of their own. Besides this, the department will be making available funding of £38 million in 2002–04 to support a programme aimed at increasing vocational and work-related learning opportunities. This will cover support for the roll-out of the new GCSEs at key stage 4, including the provision of equipment and materials.
Cattle: Tb Tests
asked Her Majesty's Government:How many herds of cattle and how many individual animals are contained in the current backlog of tuberculosis tests; and when they expect this backlog to be reduced. [HL4003]
Just under 26,000 herds currently have overdue TB tests. This represents about a quarter of the herds in Great Britain. Exact figures on the total number of cattle in herds with overdue tests are not available except at disproportionate cost but it is estimated that the number may be between 2.5 and 3 million cattle.It is not yet possible to say when the backlog of TB tests will be cleared.
asked Her Majesty's Government:Whether they have any plans to increase the frequency of routine herd tests for bovine tuberculosis in (a) Wales or (b) the rest of the country; and, if so, what the frequency would be [HL4004]
The frequency of routine testing for bovine tuberculosis (TB) is set at parish level. This ranges from annual testing in parishes with known higher incidence of bovine TB to once every four years in areas with low or no disclosed incidence of bovine TB. Large parts of the West Midlands, South West of England and South and West of Wales are already under annual or biennial testing.The frequency of testing in parishes is kept constantly under review by divisional veterinary managers and adjusted to take into account the incidence of confirmed TB breakdowns. In Wales the Veterinary Field Service carries out TB control on behalf of the Welsh Assembly Government. A similar arrangement exists in Scotland.
Marine Stewardship Report
asked Her Majesty's Government:When they intend to publish the forthcoming Marine Stewardship Report. [HL4051]
Tomorrow we will publish the first Marine Stewardship Report, Safeguarding Our Seas: A Strategy for the Conservation and Sustainable Development of our Marine EnvironmentThe report sets out our vision for the marine environment-clean, healthy, safe, productive and biologically diverse oceans and seas. It is underpinned by the principles of sustainable development, integrated management, the conservation of biological diversity, robust science, the precautionary principle and stakeholder involvement.It outlines how we are adopting an ecosystem-based approach to marine management better to integrate marine protection objectives with sustainable social and economic goals. It covers the broad spectrum of policies that affect the marine environment. As well as describing past achievements and progress made, it contains new ideas and initiatives to turn our vision into reality.Our initiatives will improve marine conservation. We will undertake our proposed regional seas pilot scheme in the Irish Sea as the next stage of our review of marine nature conservation. The report also commits us to consult later this year on the regulations to extend the Habitats and Birds Directives out to limit of jurisdiction of UK waters. It also contains a commitment to explore with other countries the case for, and feasibility of, marine protected areas on the high seas.The report announces our intention to review the regulations that affect development in coastal waters with a view to simplifying the regulatory system and protecting the marine environment. It also includes initiatives to explore the role of spatial planning for our seas at the regional level and provide a focal point to build on existing seabed mapping.In addition,
Safeguarding Our Seas commits us to review current arrangements for marine scientific research to ensure that we have the proper science base to deliver our vision. It underlines our commitment to develop our framework for environmental monitoring
and that we will produce an integrated assessment of our seas by 2004.
The report emphasises the importance of involving stakeholders in making the decisions that affect them. It announces that we will hold a joint conference of the English, Scottish and Welsh Coastal fora, together with stakeholders from Northern Ireland, on how to implement the EC recommendation on integrated coastal zone management.
Some policy matters covered in the report are the responsibility of the devolved administrations. The Scottish Executive and the National Assembly for Wales were integral to the preparation of the report. The Northern Ireland Executive has monitored progress of the report and will consider the implications for Northern Ireland.
The report is a valuable first step in turning our vision into reality: I will place copies of the report in the Library of the House. It will also be available at: www.defra.gov.uk/environment/marine.
Nhs: Funding For Treatment Of Individual Patients
asked Her Majesty's Government:Whether there has been any change in the policy of the Department of Health, as stated by Baroness Hayman on 27 January 1999 (HL Deb, col. 1009) that "we do not believe that it is proper to withdraw treatment in the midst of a course" where funding for treatment outside the National Health Service has been provided by a health authority; and whether the responsibility for funding treatment for individual patients will pass automatically from health authorities to primary care trusts. We continue to support the statement made by Baroness Hayman. Funding for treatment secured outside the National Health Service should not normally be discontinued in the midst of a course unless commissioners can secure a clinically appropriate alternative or it is agreed that a treatment is no longer clinically beneficial. Primary care trusts have the freedom to commission locally relevant high quality services for their populations from outside the NHS. Such decisions should be made on the basis of the healthcare needs of the local community and should take account of both clinical and cost effectiveness. With the shift in the balance to the frontline, primary care trusts will become responsible for the delivery of the vast majority of former health authority functions and the totality of care for the populations they serve (subject to legislation). We have allocated funding to health authorities for 2002–03 and they in turn have allocated funding to primary care trusts on the basis of the relative needs of their populations. In future the intention is that funding allocations will be made direct to primary care trusts in line with their enhanced responsibilities.
Sheep Meat
asked Her Majesty's Government:Whether they have any plans to keep ovines over 12 months of age out of the food chain. [HL3910]
A stakeholder group of consumer, industry and scientific experts has been meeting over recent months to consider whether or not, in the face of continuing uncertainty over BSE and sheep, any additional measures should be taken to protect or inform consumers. The group is considering a range of options, including some relating to the age of sheep, but has yet to report. The Food Standards Agency intends to consult fully on the stakeholder report when it is finalised.Meanwhile, the position of the Food Standards Agency remains that it is not advising against the consumption of sheep meat.
Aquariums
asked Her Majesty's Government:How many aquariums have been opened in the years 2000, 2001 and to date, with the help of lottery funding. [HL3812]
According to our Lottery Awards Database, in the years 2000, 2001 and to date, one aquarium has been opened with the support of lottery funding. The Deep project in Hull received a grant from the Millennium Commission worth £21,476,000 and opened to the public on 23 March 2002. The Deep comprises a visitor centre, learning and research centre and a business centre and forms part of the larger regeneration plans for Hull. It is Europe's deepest aquarium and has the world's only underwater acrylic lift.
Coarse Fishing
asked Her Majesty's Government:Whether they intend to introduce legislation in respect of coarse fishing based on the concept of "cruelty and utility"; and, if not, why not. [HL3840]
We have no plans to introduce legislation in respect of coarse fishing based on the concept of "cruelty and utility". Those involved in angling are aware of the need to avoid unnecessary harm and to minimise any stress caused to fish. The Government remain committed to supporting and promoting all forms of angling, including coarse fishing.
Online Gaming
asked Her Majesty's Government:Whether they propose to introduce some form of regulation or self-regulation to allow legal Internet gaming in the United Kingdom prior to introducing primary legislation, thus not forcing this industry off-shore as at present. [HL3956]
No. Primary legislation is required before online gaming could legally be operated from the United Kingdom. We intend to bring forward a Bill including provision for such gaming as soon as parliamentary time permits.
Gambling Commission
asked Her Majesty's Government:What are their plans for the transition from the Gaming Board to the proposed gaming commission; and how they propose fully to use the accumulated skills and knowledge of the Gaming Board. [HL3957]
Following publication of A safe bet for success (Cm 5397), the Government are pursuing discussions with the Gaming Board and other interested bodies to develop operational plans for the establishment of a new gambling commission. We have made clear our wish to ensure that the transition from one regulator to another is seamless, and that the new body can build effectively on the board's knowledge and skills. To this end we shall be assessing a number of transition options, including asking the board to act as a shadow commission in due course.
asked Her Majesty's Government:Who will fund the proposed new gaming commission during its start-up period before it generates its own funding. [HL3958]
Final decisions have not yet been taken on how best the necessary start-up costs of the proposed gambling commission should be met.
Prime Minister: Holiday In Egypt

Ulster Scots Language
asked Her Majesty's Government:What is their interpretation of the concepts enunciated in the Belfast Agreement of 1998 which offered total equality and parity of esteem, as far as it concerns Ulster Scots Language, culture and history. [HL3970]
The Belfast Agreement affirmed the parties' recognition of "the importance of respect, understanding and tolerance in relation to linguistic diversity, including in Northern Ireland., the Irish language, Ulster-Scots and the languages of the various ethnic communities, all of which are part of the cultural wealth of the island of Ireland".Policy responsibility for the issues referred to by the noble Lord rests with the Department of Culture, Arts and Leisure within the Northern Ireland Executive.
